1. CONCLUSION OF CONTRACT
The contract for the customer’s order is concluded with Frühwald Kft. (hereinafter referred to as manufacturer) when the purchase price has been paid or the delivery has been made.
2. VALIDITY
The “Sales and Delivery Conditions” apply to all concluded transactions, contracts and related deliveries. This can only be deviated from with a written declaration by the manufacturer’s representative. The purchaser’s terms and conditions of purchase do not apply even if the manufacturer does not object to them.
3. PRICES, OFFERS
The manufacturer’s current price list contains prices ex works. If the Frühwald Kft. and the buyer agrees in writing, they may deviate from the site price. If the raw material, energy and transport costs increase, the manufacturer is entitled to a price correction (with 10 days’ notice), which he will inform the buyer of before the start of delivery. Békéscsaba, Sóskút and Újfehértó the same sales prices apply. The manufacturer’s commitment to the offer is limited to 30 days, unless the manufacturer specifies otherwise in writing. The list price also includes the transport costs. The settlement is based on the delivery note issued by the seller and signed by the buyer or his authorized representative.
4. Content of the order
The buyer’s written order must contain the name and abbreviation of the goods to be purchased in accordance with the manufacturer’s product brochure; – the size of the ordered product; – its color (in the case of paving stones, garden elements); – its exact quantity (pieces, m², linear meters, m³); – shipping method (own, from the manufacturer); – your desired delivery date; – Recipient’s name and phone number; – Your exact delivery address.
5. Delivery, loading
The buyer must ensure the delivery of the product. Once loaded or leaving the factory, responsibility rests with the buyer or carrier. In the event of a defect or concern about the quantity and quality of the product, the product must not be processed until it is clarified. If the manufacturer receives a delivery promise that the product can be delivered to the buyer, the buyer agrees that the manufacturer may also use a subcontractor. The cost of deliveries organized by the manufacturer depends significantly on this a) in the case of transport without self-loading: the buyer must finish unloading within 1 hour of arrival, after which the downtime will be charged (in the amount of 1,500 HUF + VAT for each started half hour) and/or b) due to insufficient accessibility; c) from the incorrect designation of the construction site or delivery address; d) from the crane fee; e) from the road tax or the weight limit surcharge.
The manufacturer’s representative or distributor at the company’s locations can provide the buyer with the exact shipping costs.
6. Payment
The manufacturer accepts any type of complaint related to the sent invoice only within 8 days of receipt of the invoice. If no complaint is made within the aforementioned period, the invoice amount will be booked as an undisputed claim recognized by the customer. The manufacturer is entitled to withdraw from the concluded contract for the duration of the contractual relationship or to temporarily suspend deliveries – without assuming the costs incurred as a result a) the buyer does not comply with the agreed terms of payment, or b) the buyer becomes aware of circumstances that cast doubt on his solvency. Payment must be made at the agreed time, otherwise we will charge double the current central bank base rate as default interest and all associated costs (collection agency fees) separately. Payments are deemed settled when credited to the manufacturer’s account. Any defects or quality complaints that may occur have no suspensive effect.
7. Retention of Title
The delivered goods remain the property of the manufacturer until the claims have been settled in full (including other costs). Construction-related deliveries are also considered to be one order if they are ordered, delivered and invoiced in several partial amounts. In this case, ownership is only transferred to the buyer when all of our claims from the entire delivery have been settled. In the event of default of payment of more than 30 days or bankruptcy or liquidation proceedings against the buyer, the manufacturer is entitled to take back the goods owned by him from the buyer and to sell them. The lower costs resulting from the resale as well as the costs of the return and further delivery are also borne by the buyer.
8. Pallets
Delivery is on pallets, for which we charge a deposit and a usage fee. If the item is returned to us (the buyer bears the costs), the price minus the usage fee will be refunded. We only buy back undamaged pallets, please prove ownership with the delivery note.

9. Return of Materials
The manufacturer will only take back goods delivered as surplus based on the buyer’s order after prior agreement and only if the goods are undamaged and in their original packaging. A copy of the invoice must accompany the returned product. When buying again, the manufacturer charges a processing fee of 20% of the value of the goods. Buyback is possible within 6 months of delivery at any of the manufacturer’s locations.
10. Warranty
We guarantee the technical properties and quality requirements of our products in accordance with the statutory provisions. Up to 2% of the quantity delivered. Minor deviations that do not impair the intended use are permissible according to the regulations. After receipt by the buyer or his representative, the goods are to be assessed in terms of quantity and quality. After such an inspection, the goods complained about may no longer be installed and the complaint must be reported to the manufacturer in writing within 3 days at the latest. After acceptance, the manufacturer can only deal with complaints arising from hidden defects (not recognizable at the time of acceptance) that can be traced back to manufacturing errors. In the event of a complaint, the Frühwald Kft. can only be proven on the basis of the invoice. We are able to exchange products manufactured by Products not yet installed may be eligible for a replacement warranty with prior written approval from the manufacturer’s representative. The blooming that occurs is technically unavoidable, does not affect the quality parameters and the utility value of the product and is therefore not considered a warranty defect! With stress and the inevitable natural pollution during this process, the efflorescence will disappear. Corners and edges of paving stones and paving slabs laid on insufficiently compacted subsoil can break off when shaken. The causes for this are insufficiently compacted bedding, improper laying, non-compliance with the alternating joint spacing as paving stone, shaking without a rubber sheet. The color of the natural materials used varies, including that of the cement. Due to the different production times and the difference in the materials used, there may be color differences in the normal, starting, key and edge stones. These color differences are technically unavoidable, but do not reduce the practical value of the product, weather and use increase them homogeneous. No guarantee is given for color deviations, lime efflorescence and elementary damage! In the case of quality doubts or concerns, the product must not be installed until the problem has been clarified! In this case, no costs (e.g. bringing, picking up) can be claimed from the manufacturer!
11. Cancellation
If the customer of the von Frühwald Kft. If the contract is confirmed in writing, we will charge him a contractual penalty of 10%. For individual orders, 40% of the price is to be paid as a deposit. If the customer withdraws from the contract, the Frühwald Kft. the advance payment as compensation.
12. Legal Effect
In matters that are not regulated in the “Sales and Delivery Conditions”, the provisions and guidelines of the Civil Code apply. In the event of a dispute, the Municipal Court of Békéscsaba has jurisdiction. We thank you for your trust and hope that you will enjoy the products of Frühwald Kft for a long time.

PRICE LIST INFORMATION:
The prices in the price list are on site. The weight of the products and the material consumption are rounded values. When billing, we take into account the net unit prices for running meters, pieces. and m². Gross prices are rounded according to rounding rules. Prices include 27% VAT. Our products, whose individual prices are marked in green, can be delivered immediately from stock, the rest – in the case of an order – with a short production time. Technical changes reserved! We assume no liability for printing and editing errors!
